TOWN OF LIBERTY GROVE. SPECIAL BOARD MEETING. TUESDAY MAY 20, 2008. At the Town Hall, the meeting was properly noticed.

 

Agenda topics:     

                   1. Call to order

                   2. Roll call

                   3. Pursuant to Sec. 82.27(4)(a), consider the application of Wayne Logcrafters, LLP, dated April 15, 2008 and filed with the clerk of the Town of Liberty Grove on April 21, 2008. Should the applicant or any party opposing the application wish to present additional facts prior to a decision of the Town Board, the Board reserves the right to postpone a decision until these additional facts have been presented to it.

                    4. Consider:

                          A. “Advantages” under Sec. 82.27 (1) of the Wisconsin Statutes:

              i. the increase in value of the landlocked property after the highway is laid out

             ii. The administrative costs under Sec. 82.27(5), Wis Statutes, including but not limited to:

a.        Attorney fees reasonable incurred by the Town.

b.       The cost of any survey or the fee of any expert on valuation or both, reasonably incurred by the Town.

c.        Administrative costs such as clerical costs and publication costs.

d.       Per diem compensation for the supervisors for the special meetings held for the purpose of considering the application

                       B. Damages to owners of real estate on which the highway shall be laid out

                      C. Charging of such advantages, costs and damages to the applicant.

                      D. Issuing of highway order

This meeting is held pursuant to Wis. Stat. 82.27 for consideration of an application by Wayne Logcrafters, LLP.

 

Chairman Casey called the meeting to order at 7:25 PM. Also present: Supervisors Miller, Tidball, Goss, Jensen, Clerk/Administrator Kalms, Attorney Robert Kay and about 30 citizens who also attended the hearing which began at 5:32 PM.

 

 

Kalms mentioned letters the Town has received in opposition to the road as petitioned for: Door County Soil & Water, Dept. of Army Corps of Engineers, Nature Conservancy, Wis. Dept. of Natural Resources, Door County Planning, and a letter signed by several Town citizens.

Casey felt we should postpone a decision to get: a determination if the right of way as laid out in 1898 goes to the lake, and address the access vs. wetland filling issue. Kay said should the right of way be deemed to be discontinued, advantages would have to be determined if the Sec. 82.27 application is granted. He noted that 82.27 (4) calls for a 66 foot wide road unless that width is deemed impracticable; he has no opinion if a 12 foot “freeze down road” would work; also, a couple of years ago the adjacent owners got together with the former owner of the Lautenbach parcels but no agreement was able to be worked out.

Goss moved, Tidball second to table until proper information can be obtained. Discussion: the issues are: Corps decision on road leading to navigable water (North Bay); obtaining the contracts of Lautenbach and Sunstrom; is a “freeze down road” allowed per D.O.T. standards. The motion carried 5-0.

Miller/Goss to adjourn. Carried 5-0. 7:43 PM.
