Address request by Frank Forkert for Hazardous and Toxic Waste Recycling Program for Liberty Grove on year around basis vs. County of Door bi-annual program– feasibility/scope/options available locally now/costs associated with/ insurance and legal input/ research/discussion/ recommendations to Board for any action.
9. Sanitary District 1 – Statutory requirements – discussion /review of sample ordinances / plans for development appropriate to Liberty Grove.
10. Joint informational /exploratory meeting with/at Gibraltar Plan Commission (Tuesday, Oct 27) in regards to Sanitary District ordinances in regards to rural towns report on meeting.

The meeting was called to order at 8:07 by Chairman Ann Miller. Nancy Goss was present, Robert Tidball did not attend. Frank Forkert was also in attendance as well as Officer Paul Keddell of the Door County Sheriff’s Office.

Miller moved, Goss second to approve the agenda, switching the order of items #9 and #10. Passed 2-0

Goss moved, Miller second to approve the minutes of October 6, 2009. Passed 2-0.

Correspondence: A letter from Mrs. Vitus Kostohryz was reviewed by the committee.

Public Input: Frank Forkert expressed his desire that the HSW Committee recommend to the Town Board that they move forward in the negotiations of an agreement between the Village and the Town and the sanitary treatment plant use.

Discussion on use of fire arms at the Mink River Rd gravel pit: Miller felt we don’t have any legal authority to require the property owner give out permits to use the land to fire guns. The question was also raised that if the owner gives permission to people other than his family does this create a “shooting range” by County definition. A shooting range is not allowed in SF30 zoning district but there will have to be a determination as to whether this is a shooting range by definition. As long as they are shooting at least 50 feet from the center line they are not violating any other laws. Officer Keddell reported that a license isn’t required to own a gun. Frank Forkert commented that the use of rapid fire guns creates a lot of noise. He has been woken up by them on the weekends. Goss felt the only legal thing we could do would be to pass a time restraint ordinance of some kind to limit the noise but this
would have to apply to everything from jet skis to leaf blowers. Miller said it would be helpful if people would formally complain about the noise. That way there is a record of the number of complaints. Office Keddell said that too many complaints coming into the non-emergency number only creates extra work for the officers when there really aren’t any laws being broken. They can respond but they can’t stop the shooting. It was suggested that we approach the family, explain the concerns of the neighbors and ask that they limit the amount of shooting that goes on to help keep the noise down.

Hazardous and Toxic waste program- Miller found out that if we were to operate a collection site on a regular basis we would have to have at least 2 people present at all times, properly dressed and trained. Everything coming in would have to be properly contained and the generator of the waste recorded. There is a trip charge, minimum of $1,000 to pick it up. You also need to have storage while you are waiting for the waste to be picked up. The County reported that the last hazardous waste drop off cost $23,473.62. We already pay for this service through our taxes so why would be want to spend money to do our own. Miller suggested that we put on the Town website places that will accept certain types of waste for a small fee. She also suggested a paint swap for leftover latex paint. Scrap metal can be sold to Sturgeon Bay Iron and Metal. Right now they have very little. Janet Johnson also reported that our insurance carrier would not cover a hazardous/toxic waste service of any kind, nor does it cover our employees to work at such a site.

Concerns about conditions at the John Olson property: The motel is no longer licensed to operate. A call was made to the Department of Revenue and there is no sellers permit on file. If he is running a continuous yard sale he would need one. To date sales tax hasn’t been paid. The zoning book referred to square footage of space required to operate a store but this wouldn’t apply as the sales are taking place outdoors. Goss feels that there are personal issues in this matter and that some compassion should be used. The committee talked about informing the County Sanitarian and bringing him back in. Miller moved, Goss second to recommend to the Town Board that the appropriate agencies be contacted at the County level to assist in remediating the situation as it currently exists. Passed 2-0.

The committee took a 5 minute break.

Sanitary District #1 – The committee decided to bring this item up at an upcoming working session, the dated to be decided during future meetings.

Joint informational meeting- Gibraltar would like to sit in on the meetings dealing with Sanitary District ordinances but don’t really want to join in until we have them worked on. They expressed interest in how the Town has turned the entire Town into the Sanitary District with smaller utility districts. It was suggested that they be brought in towards the end and they can help finish and fine tune the ordinances.

Future meetings: January 7, 2010 at 8:00am will be the working session for Sanitary Dist. #1 ordinances.

Miller moved, Goss second to adjourn at 9:49am. Passed 2-0.
