February 3, 2010 Town Board Minutes

TOWN OF LIBERTY GROVE. FIRST FEBRUARY BOARD MEETING. WEDNESDAY, FEBRUARY 3, 2010. At the town hall, the meeting was properly noticed.

B. Discuss/consider adoption of utility ordinance for utility district
C. Consider adoption of Tourism Zone commission #5-012110, to change the date of the annual
Tourism Zone Commission meeting
D. Discussion/consider action on request to pay for aerial photography of Town parcels which
outlines buildings
E. Petition for zoning amendment: outdoor advertising signs along scenic byway corridor conform
to state and federal regulations-discuss and consider action
F. Consider adoption of “Declaration of Land Use Restriction” for Hidding purchase
8. Payment of bills
9. Adjourn

Chairman Lowry called the meeting to order at 7:00 PM. Also attending: Supervisors Miller, Tidball, Goss, F. Forkert, Clerk/Administrator Kalms and 7citizens.

Lowry/Forkert to adopt the agenda as published. Carried 5-0.
Miller/Goss to approve the 1/11 Special Board minutes as presented. Carried 5-0.
Forkert/Miller to approve the 1/20 Board minutes as presented. Carried 5-0.

Public input: Several citizens asked to speak during the meeting.

Tourism zone report. Goss reported that research is being done on lodging establishments to see if they are properly permitted; room tax proceeds through November are down by 0.7% from last year; TZC annual meeting date is proposed to be changed to help with audit deadlines; a ratio of 3/1 exists between units and permits.

Aerial truck disposition. The current 50 foot aerial truck will be sold now that a new 100 foot unit has been ordered. Lowry noted that the Fire Board Agreement does not mention disposition of equipment, but shows that the Fire Board owns the equipment; a disposition section could be added to the agreement. Tidball said the sale proceeds could be factored into the Fire Board budget. This topic will be discussed at a future Fire Board meeting.

Utility ordinance. Peter Sauer said the Utility District, former Sanitary District #1, has been operating under the Village utility ordinance, which is not enforceable in the Town. Utility ordinance 1-10 will facilitate this enforcement concern. The utility commission has worked out this ordinance and Town counsel has reviewed it and suggested minor changes, incorporated into the ordinance as presented tonight. Forkert moved, Lowry second to adopt ordinance 1-10. Roll call vote: Aye—Forkert, Lowry, Goss, Miller, Tidball. Nay –0. Carried.

Tourism Zone Commission resolution. This resolution is presented to allow flexibility in setting the TZC annual meeting so audit and other dates can more easily be met. Goss moved, Lowry second to approve the resolution as presented by the Tourism Zone Commission. Carried 5-0.

Request for payment for aerial photography which outlines buildings. Kalms mentioned that the original decision by the Board in 2008 was to authorize the standard flyover photos and not pay for any enhanced imaging. The GIS department added building outlines to the project. No contact was made to the Town prior to this taking effect. Tidball moved, Lowry second to not pay for building outlines photo enhancement in the aerial photography project. Carried 4-1, Miller nay.


February 3, 2010 Town Board

Zoning amendment for signage along scenic byway. Miller said a scenic byway as is being applied for must bring signs into conformance with state & federal guidelines; this does not result in any cost to the Town; current signs stay as is. Forkert moved, Miller second to approve the proposed County zoning amendment for the scenic byway. Carried 5-0.

Declaration of land use restriction for Hidding purchase. Coastal Management is requiring certain language to be recorded to restrict certain actions on the Hidding purchase prior to release of grant funds that have been awarded to the Town. The Board was concerned as to what these restrictions actually are, and if this would affect activities the Town may develop for public use there. Kalms will research this with Coastal Management, along with any LAWCON requirements.

Miller/ Goss to approve bills as presented. Carried 5-0.
Tidball/Miller to adjourn. Carried 5-0. 7:49 PM.
