TOWN OF LIBERTY GROVE. SPECIAL BOARD MEETING. MONDAY JANUARY 11 2010. At the Town Hall, the meeting was properly noticed.
Agenda: 1. Call to order
2. Roll call
3. Adjourn to closed session per Stat. 19.85 (1)(g): confer with legal counsel for the governmental body who is rendering oral or written advice concerning strategy to be adopted by the body with respect to litigation in which it is or is likely to become involved-Old Stage Lane right of way access to southerly parcels
4. Reconvene in open session to consider announcement on closed session item
5. Discuss/consider action regarding resolutions 1-09, 3-09, 4-09 pertaining to Old Stage
Lane
6. Adjourn to closed session per Stat. 19.85 (1)(e): deliberating or negotiating the purchasing of public properties, the investing of public funds, or conducting other specified public business, whenever competitive or bargaining reasons require a closed session—consider possible acquisition of Gills Rock parcels
7. Convene in open session
8. Consider announcement or action on closed session items
9. Adjourn
Chairman Lowry called the meeting to order at 5 pm. Supervisors Miller, Goss, Forkert, Tidball, and Clerk/Administrator Kalms also attended.
Closed session. Lowry moved, Miller second to adjourn to closed session per the agenda item as read-Stat. 19.85(1)(g). Roll call vote: Aye-Lowry, Miller, Goss, Tidball, F. Forkert. Nay-0. Carried 5-0. Discussion with legal counsel ensued. Forkert moved, Miller second to reconvene in open session. Roll call: Aye- Forkert, Lowry, Miller, Goss, Tidball. Nay-0. Carried 5-0.
There were 8 citizens attending the open session.
Resolutions pertaining to Old Stage Lane. Lowry said the Board has been talking with attorney Bob Mich in closed session. Miller said the Board is in consensus to allow the harvesting to start; the resolution calls for a valid certificate of insurance, but does not know if we have a valid one at this point. Wayne Lautenbach produced an old map that showed access by Old Stage Lane from the north; he does not take the resolutions as is; his next step is a law suit and getting permits to build; he quoted Carrie Webb of the DNR that there are exceptions to a town road. Miller pointed out resolution 1-09, item #7 stating costs are to be borne by the owner of record. Lautenbach said the board voted on a new road order. Goss said she was on the Board at the time, and the reason the Board voted to not put in the road were because of all the required steps to go through (for a water quality certification); there are many roads in the state that are not worked; the Board has to be responsible with tax dollars; we have done what we can to provide access. Lautenbach: number of people to access is irrelevant; he is building a cabin now to put there; he will do a lis pendens; he has offered the land to the Town in the past; the road is not his to do; he is sorry the neighbors are upset with him, but is confident of the outcome; “no way” will he pay to cut a road in. Lowry said the Board will continue with resolutions 1-09, 3-09 and 4-09, and want to continue with the freeze down road. Miller mentioned Lautenbach can start working on the freeze down road. Lautenbach then left at 6:38. Lowry moved, Goss second that the Town continue with the terms of resolutions 1-09, 3-09 and 4-09. Carried 5-0.
Closed session, Gills Rock. Miller moved, Lowry second to adjourn to closed session per the agenda item as read-Stat. 19.85(1)(e). Roll call: Aye-Miller, Goss, Forkert, Tidball, Lowry. Nay-0. Carried 5-0. After discussion, consensus was to meet again on January 13 at 6 PM. Lowry moved, Miller second to reconvene in open session. Roll call: Aye- Lowry, Miller, Goss, Forkert, Tidball. Nay-0. Carried 5-0.
Announcement on closed session. Lowry said the Board will meet on January 13 at 6 PM in closed session again on Gills Rock.
Lowry/Tidball to adjourn. Carried.
