Chairman Goss called the Commission meeting to order at 7:00 p.m. Also present: Commissioners Miller, Sauer, Karkau, Shumway, Nelson and Clerk/Administrator Kalms. Commissioner Forkert was absent. Laurel Braatz of DNR, J. Grasse, R. Anderson, F. Forkert, Buzz Madsen also attended.

Miller/Nelson to adopt the agenda as published. Carried 6-0.
Sauer/Miller to approve the 7/20/09 minutes. Carried 6-0.

Laurel Braatz-DNR Water Specialist. Braatz handed out a letter clarifying codes regarding wells; variances are not normally issued for old 4 inch wells; DNR has no money for well replacement; abandonment procedures are filling with cement or bentonite chips; few records exist for 4 inch wells; sampling of wells is hard to track, as people can use any lab they wish; Chris Olson of DC Sanitarian’s office did a research project in the central part of the County, so data could be tracked, otherwise there is no coordinated testing for areas that could have problems.

Variance for second floor addition: Richard Anderson at 1234 Garrett Bay Road. Anderson said he has a variance and zoning permit to construct his addition, but some structural factors now require a 28 foot height; he said he needs the addition because of family size plus the need for an office area; averaging allows a 40 foot setback, but he is at 24 feet. Goss reminded of the three criteria: harm to public interest, unique features, hardship; she emphasized the Commission is not trying to penalize anyone, but must follow the law. Nelson did not see a hardship. Sauer felt there is a hardship with the existing limited room. Anderson said he needs the height even with a smaller addition. Goss said if he stays back 40 feet from the high water mark he would not need a variance; the reasons the Board of Adjustment gave for granting the variance in 2007 did not meet the criteria. Goss moved, Nelson second that the Town Board deny the request by Richard Anderson at 1234 Garrett Bay Road for the variance because a hardship for unique property limitations is not proven. Carried 5-1, Sauer voting nay.

Comprehensive Plan Review, Ch. 7. Suggested changes to chapter 7: p. 144—I NVENTORY OF PLANS AND AGREEMENTS, eliminate last sentence of that section and substitute with “The Town of Liberty Grove as part of Smart Growth Planning encourages semi-annual meetings between joint governmental bodies whenever practicable”. Page 144, Extra-territorial subdivision regulation, add a sentence at the end of this paragraph to read “Special attention should be paid to areas of overlapping intergovernmental interest”. Page 145, Extra-territorial Zoning, eliminate second to last line in this section, which reads “Extra territorial zoning is not currently being administered in the Town of Liberty Grove”.

Next meeting is August 24 at 7 PM.

Goss/Miller to adjourn. Carried 6-0. 8:33 PM.
