Chairman Goss called the meeting to order at 7:01 PM. Also attending: Commissioners Nelson, Karkau, Sauer, Shumway, Miller and Clerk/Administrator Kalms. R. Forkert did not attend. Frank Forkert and attorney Jim Smith also attended.
Sauer/Nelson to adopt the agenda as posted. Carried 6-0.
Shumway/Goss to adopt the 12/7/09 minutes. Carried 5-0-1, Miller abstaining.
Miller/Nelson to adopt the 1/11/10 minutes as corrected. Carried 6-0.
Goss would like to postpone agenda item #6 until this topic is discussed by the Towns’ Association representatives at the County meeting on March 25. Commissioners agreed.
Town Comprehensive Plan Review: General Plan Design (GPD) Map. Attorney Jim Smith represented Bruce Raemisch of Fox Ridge Estates; the GPD map shows his land as Natural Area, whereas small adjacent lots are shown as single family (SF). He said Raemisch would probably sue the Town if they do not change Fox Ridge Estates’ GPD classification to match the zoning map. He mentioned the development standards on page 166 of the Town Plan: “The intent of the plan is for these classifications to be consistent with the zoning districts within the Door County Zoning Ordinance that are in existence within the Town of Liberty Grove, and to ease future implementation of the Plan and coordination with the County”. Sauer felt there was no problem if Raemisch does not want to change his lots. Goss mentioned that Mariah Good of DC Planning has said that changing the GPD map to match zoning was not necessary; this would maintain consistency in the Plan. Goss said that even though adjacent parcels are SF, Fox Ridge Estates is closer to the water and is a recharge area for those bodies of water. Sauer interprets page 166 differently: the classifications of the GPD match DC Planning—if Raemisch wants to change, the Commission could consider it—but if he wants no changes now, there is no reason to consider changing the GPD. Shumway feels the intent is to create future zoning. Goss said to control zoning, not to create it; the goal of the GPD is to protect water quality and sensitive areas—therefore, general areas and not specific parcels were addressed (in designating NA areas, for example).
Sauer asked clarification of the south side of highway 42 at Northport—commercial is not depicted on the County Future Use map as broad as it is on the Town GPD map. Consensus was to leave the Door Bluff area at the County Park as is. A marina would fit into the commercial area depicted at Gills Rock. Goss said she is comfortable with the work done on the GPD map. Kalms mentioned that Heron Ridge has been reconfigured and is not concerned with the GPD now; Sauer asked to clarify with DC Planning if zoning change applications are complying with the Town Plan as specified in Smart Growth legislation; Goss mentioned a certified survey ordinance whereby the municipality would require signing off on new lot creations.
Next meeting will be 2/8, with GPD mapping south of Waters End Road to be reviewed.
Miller/Sauer to adjourn. Carried 6-0. 8:01 PM.
