TOWN OF LIBERTY GROVE. SECOND JANUARY BOARD MEETING MINUTES. WEDNESDAY, JANUARY 18, 2012. At the town hall, the meeting was properly noticed.

Chairman Lowry called the meeting to order at 7:00 PM. Also attending: Supervisors Miller, Goss, Tidball, F. Forkert, Clerk/administrator Kalms, Treasurer Johnson, County deputy Sitte, with John Holtan and Ryan Anderson of Associated Appraisal, new Town assessors. About 12 citizens also attended. The pledge of allegiance was recited.

 

Tidball/Goss to adopt the agenda as presented. Carried 5-0.

 

Miller/Goss to approve the 1/04/11 minutes as presented. Carried 5-0.

 

Public Input.  Harvey Stahl wondered how a landowner can check on his assessment. Janet Johnson said she can check on the computer or the new assessor can be contacted. Several citizens asked to speak on #9 and also 10. B.

 

Town assessor. John Holtan and Ryan Anderson of Associated Appraisal spoke for the new Town assessor.Holton said they have provided a form that can be filled out for asking questions; they use the cost approach in valuing property; their website is apraz.com to download forms; real estate appraisals are different than assessor values; assessors can’t use short sales or sheriff sales in their work; they presented the Town with two different contracts; the Town is taking a proactive approach whereby 20% of the parcels will be evaluated yearly with areas being adjusted that may be out of whack; they will be in the Town more than one day per month and can be available to meet with citizens; waterfront property appreciates faster than off shore parcels. When asked about changing values, Ryan Anderson said the landowner can object every year if he feels his assessment is not correct.

 

Assessor contract. Kalms suggested approving the contract subject to a couple of changes that have not been made; this will get worked out in the next couple of days. Lowry moved, Forkert second to approve the contract with Associated Appraisal pending agreement on the items our attorney asked for. Carried 5-0.

 

Road maintenance policy. Carole Maronek read a statement: concerns from trimming; no notice given; setback from 6 to 16 feet; forestry maintenance classes; trimming week of 12/5 on E. Door bluff & Door Bluff; major pruning on 100+ trees; concerned about aesthetics; want a dialogue; pictures presented; Jay & crew did great job on E. Door Bluff. M. Bahrke: does not recall newspaper/website notification; 24/48 hour notice would be o.k. L. Covatsos:

notify so people are not surprised; do nothing too drastic without notice. J. Maronek: Heritage Road proposal will address these things. S. Uglinica: on vacation for 3 months; still has 15 feet of his birch tree; an oak and another tree were taken; Isle View cutting was delayed until most of the residents were gone—underhanded; where is his wood. Lowry has asked Jay from the Town crew to hold a seminar to show how cutting is done; instead of stubs it is better to remove the branch to the tree; cutting is progressing faster this year due to lack of snow. Miller said people are stealing the wood; that is where Uglinica’s may have gone. Miler wondered if the wood could be sold after 72 hours with the money to the Town; Steve Christy has said if you have to trim a lot on one side it may be best to take the whole tree; a logging professional may but it; some is too big for residents to haul away.  Forket said we could take the wood to the Town and then let anyone get it. Kalms said then if someone gets hurt on Town property the Town can be liable for their injuries; there was an ad in the paper in July of impending tree trimming. Other thoughts were that a newspaper ad does not work; 24 hour notice would work on the website. Uglinica said his group had approached the County who implemented regular training.

 

Highway Committee. Hanson Lane. The recommendation is to move forward with improvements. Miller moved, Forkert second to improve Hanson Lane at the time it is required. Carried 5-0. Hill Road. Kalms explained that there are no stretches of 1,000 foot minimum that meet the average 150 foot spacing between buildings that would authorize the Board to lower the speed limit to 35 mph. He presented the results of the speed board that was installed earlier in the year: out of 4,864 vehicles 55.84% are traveling between 1 and 25 mph; 19% between 25 & 35 mph; 10% between 35 and 40 mph; 15% over 40 mph. Forkert felt the 25 mph limit should be the same as the Village. Miller said the recommendation is to install 35 mph cautionary signs further out. Paul Salm of 2188 Hill Road said you can’t see over the hill; people do not think this is a busy road; the shoulders are steep for walking along the road. Miller moved, Goss second to install “children at play” with 35 mph yellow caution signs, one eastbound outside the Village and 1 westbound before the hill. Carried 5-0.

 

Resolutions of appreciation. Lowry read resolutions of appreciation for the services of Town Assessor David Dorschner and County Emergency Services Director Richard Burress, both of whom retired recently. Lowry moved, Tidball second to approve the resolution as read for David Dorschner. Carried 6-0. Lowry moved, Goss second to approve the resolution of appreciation as read for Richard Burress. Carried 6-0.

 

Plan Commission recommendations. Huppertzvariance to extend deck walkway within 30 feet of

ordinary high water mark. Commission chairman Goss said the Commission is recommending support as this variance satisfies the criteria for a variance, there being no harm to the public interest and is a good example of asking for minimum relief. Goss moved, Forkert secondthat the Board send a letter of support to the Board of Adjustment for the Huppertz variance. Carried 5-0. Hilanderconditional use permit for expansion of  campground/RV park. Goss reported that Hilander is adding 68 new sites, 33 right away and 35 in the future; has 20 acres minimum as zoning requires; Commission requests a condition of downcast lighting for the new area. Goss moved, Miller secondto approve the Hilander application with the provision of requiring downcast lighting. Carried 5-0.

 

Town records access. A new ordinance has been drawn up for access to and charges for Town records. Miller moved, Tidball second to adopt ordinance 1-12. Roll call: Aye—Forkert, Miller, Goss, Tidball, Lowry. Nay—0. This ordinance is attached to these minutes.

 

Request for waiver of Section 8(a),Town Alcohol Beverage Ordinance 1-84 . Patrick Doherty is requesting a waiver of the section of ordinance 1-84 on the distance a liquor store can be from a church.He is contemplating an establishment at 2741 Highway 42, which is close to the property line but just under 300 feet from a church to the east. Miller moved, Lowry secondto waive the 300 foot requirement for Doherty at 2741 Highway 42 on Little Sister Hill. Miller moved, Lowry secondto amend to make the waiver subject to Doherty purchasing the parcel at 2741 Highway 42. Carried 5-0. The amended motion then passed 5-0.

 

Operator license. Miller/Tidballto approve the operator license for Lou Covatsos. Carried 5-0.

Miller/Gosspay bills as presented. Carried 5-0

Lowry/Gossto adjourn. Carried 5-0. 8:55 PM.

ORDINANCE ADOPTING NOTICE OF RECORDS ACCESS

 

STATE OF WISCONSIN

Town of Liberty Grove

Door County

 

Ordinance 3-09 and its notice of records access is hereby repealed.

 

The Town Board of the Town of Liberty Grove, Door County, Wisconsin, has the specific authority under s. 19.34, Wis. Stats., to adopt this ordinance.

 

This ordinance, adopted by a majority of the town board on a roll call vote with a quorum present and voting and proper notice having been given, adopts the Notice of Records Access as contained herein, which, pursuant to s. 19.34 (1), Wis. Stats., contains a description of the town’s organization and the established times and places at which, the legal custodian from whom, and the methods whereby the public may obtain, information from and access to records in the town’s custody; make request for town records or obtain copies of town records; and the costs thereof.

 

NOTICE OF RECORDS ACCESS

 

The clerk of the Town of Liberty Grove, Door County, Wisconsin, by this notice states that the clerk of the Town of Liberty Grove has been designated under s. 19.33, Wis. Stats., as the legal custodian of records for the Town of Liberty Grove, except that elected officials are the custodians of their own records of office and chairpersons of committees of elected officials are custodians of the records of the committee.

 

The town clerk maintains regular office hours of 8:30 AM to 11:30 AM and 1 PM to 4 PM Monday thru Friday, except legal holidays, at 11161 Old Stage Road.

 

As required under s. 19.34(1), Wis. Stats., each Town Local Public Office is listed below. The public may obtain information and access to records in the custody of elected officials and chairpersons of committees of elected officials, as the custodians of their own records of office, make requests for records, or obtain copies of records, and learn the costs of obtaining copies of records from the elected official or chairperson in accordance with the contact information designated as follows:
